Terms of Service

Welcome to DressageTunes.

These Terms of Service ("Terms") govern your use of the DressageTunes website, services, and products operated by DressageTunes ("we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the service.

1. Services overview

DressageTunes provides:

  • Music Library — a curated collection of tracks suitable for dressage freestyle routines.
  • Find BPM Tool — a metronome to measure your horse's stride tempo.
  • Freestyle Builder — tools to plan and organize your freestyle music.
  • Custom Edit Services — professional music editing matched to your choreography.
  • Licensing Guidance — information about music licensing requirements by track type and competition level.

Important: DressageTunes operates as an editing service. We provide music recommendations and licensing guidance, but we do not sell, distribute, or host copyrighted music files. Riders obtain tracks legally themselves.

2. Accounts and registration

2.1 Account creation

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information.
  • Maintain the security of your password.
  • Accept responsibility for all activities under your account.
  • Notify us immediately of any unauthorized access.

2.2 Age requirements

Minimum age: you must be at least 13 years old to create an account. This is required for COPPA (US) and GDPR (EU) compliance.

Under 13: children under 13 cannot create accounts directly. A parent or guardian may create an account and supervise the child's use of DressageTunes to find music for their pony or horse freestyle.

Under 18: users between 13–17 should have parental or guardian consent. The parent or guardian is responsible for ensuring appropriate use.

3. Subscription plans

3.1 Plan types

We offer the following subscription tiers:

  • Free — basic access with limited features.
  • PRO (€7.99/month or €79.99/year) — extended previews, PRO contact details, priority delivery, 10% edit discount.
  • MAX (€13.99/month or €139.99/year) — full features, email templates, licensing guide PDFs, fastest delivery, 20% edit discount, free 1-week rush.

3.2 Billing and renewal

Subscriptions are billed in advance on a recurring basis (monthly or yearly). Your subscription will automatically renew unless cancelled at least 24 hours before the renewal date.

3.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You retain access until the end of your current billing period.
  • No refunds are provided for partial periods.
  • Your saved horses and freestyles remain accessible at the Free tier limits.

3.4 Refunds

Subscriptions: under EU law, you have a 14-day cooling-off period from the date of purchase. To request a refund within this period, contact us before using any premium features. After the cooling-off period, subscription fees are non-refundable.

After 14 days: if you experience technical issues preventing use of the service, contact us within 7 days for evaluation.

4. Custom Edit services

4.1 Service description

Custom Edits are choreography-matched music productions that include:

  • Tempo adjustment to match your horse's stride (±10%).
  • Professional crossfades between sections.
  • Choreography matching based on your video.
  • Competition-ready audio mastering.
  • Three (3) revision rounds.
  • Downloadable Licensing Guide PDF (MAX tier).

4.2 Video submission

A choreography video is required for us to create your custom edit. You may:

  • Submit your video link at checkout, or
  • Pay now and email your video link later.

Important: your delivery timeline begins only when we receive a working, accessible video link, not from the date of payment. If your video link is broken or inaccessible, we will contact you and the timeline will restart once a working link is provided.

4.3 Delivery times

Delivery times are measured from when we confirm receipt of your working video:

  • Standard (Free tier): 3 weeks (21 days).
  • Standard (PRO tier): 2 weeks (14 days).
  • Standard (MAX tier): 1 week (7 days).
  • 1-Week Rush: 7 days (+€30, free for MAX).
  • 3-Day Rush: 3 business days (+€50).

4.4 Revisions

Each Custom Edit includes three (3) revision rounds. Each revision round may include up to 3–5 specific change requests. Additional revisions beyond the included rounds may incur extra fees.

4.5 Refund policy for Custom Edits

Editing services and subscriptions are non-refundable once work has begun. If you cancel before we receive your video and begin work, contact us for a refund evaluation.

4.6 Your content rights

By uploading videos, floorplans, or audio files you grant DressageTunes a worldwide, royalty-free, perpetual license to use short clips (max 30 seconds) for promotional purposes and to use all data (BPM, choreography, horse type, etc.) anonymously to improve our service and train future AI tools.

5. Music and licensing

5.1 Our role

DressageTunes provides licensing guidance based on six track types:

  • License-Free (Green): DT originals, stock music, public domain — no clearance needed.
  • Creator Original (Green): independent artists — one email covers all rights.
  • Commercial Cover (Yellow): store-bought covers — buy recording + PRO clearance.
  • YouTube Cover with Contact (Red): contact artist + PRO for original.
  • YouTube Cover No Contact (Red): research required, consider alternatives.
  • Remix (Red): multiple clearances needed.

5.2 Rider responsibility

You are solely responsible for obtaining all necessary licenses for competition use. We provide guidance and contact information, but:

  • We do not obtain licenses on your behalf.
  • We cannot guarantee accuracy of PRO contact information.
  • Licensing requirements may change without notice.
  • Federation rules vary by country.

Licensing disclaimer: DressageTunes provides licensing guidance for informational purposes only and is not a legal service. Requirements vary by country, federation, and event type. Always verify with your national federation and consult local regulations before competing. When in doubt, seek professional legal advice.

5.3 Recommendation: ClicknClear

For non-green tracks, we recommend checking ClicknClear first. If your track is listed, one payment (€10–25/year) covers all rights for any competition level worldwide.

5.4 Your content

Videos you submit for Custom Edits remain your property. By submitting, you grant us permission to view and use the video solely for creating your edit.

6. Acceptable use

You agree not to:

  • Share your account credentials with others.
  • Download or redistribute tracks from our library.
  • Use the service for any unlawful purpose.
  • Attempt to access areas of the service not intended for you.
  • Interfere with or disrupt the service.
  • Use licensing guidance as legal advice.

7. Intellectual property

The DressageTunes service, including our website design, logo, and original content, is protected by copyright and trademark laws. You may not copy, modify, or distribute our content without permission.

Custom Edits created for you are licensed for your personal and competition use only. You may not resell or redistribute your custom edit.

8. Limitation of liability

To the maximum extent permitted by law, DressageTunes shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

Specifically: DressageTunes accepts no liability for competition compliance, disqualifications, fines, or legal issues arising from incomplete or incorrect music licensing. Licensing guidance is provided as a convenience only.

9. Account termination

9.1 Termination by you

You may terminate your account at any time through your profile settings or by contacting us. Upon termination:

  • Any active subscriptions will be cancelled (no refund for remaining period).
  • Your personal data will be deleted within 30 days.
  • Completed Custom Edits remain yours to keep and use.
  • Invoice records may be retained as required by German tax law (7 years).

9.2 Termination by us

We may suspend or terminate your account if you:

  • Violate these Terms of Service.
  • Engage in fraudulent or illegal activity.
  • Share account credentials with others.
  • Attempt to download or redistribute library content.

We will notify you by email before termination, except in cases of serious violation.

9.3 Effect of termination

Upon termination, your right to use the service ceases immediately. Sections that should survive termination (Limitation of Liability, Governing Law, Intellectual Property) will remain in effect.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the new Terms.

11. Governing law

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Nürnberg, Germany.

12. Force majeure

DressageTunes shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to: natural disasters, war, terrorism, strikes, government actions, power failures, internet outages, or third-party service provider failures (e.g., Firebase, Stripe, Airtable).

In the event of force majeure affecting Custom Edit delivery, we will notify you promptly and extend your delivery timeline accordingly at no additional cost.
